資料データ利用者への利用規約 Terms of Use for Data User

　この利用規約（以下「本規約」といいます。）は、合同会社AMANE（以下「当社」といいます。）がhttps://ourarchives.amane-project.jp/ （以下「本サイト」といいます。）において提供するAMANE Archives（以下「本サービス」といいます。）の利用にあたり、利用者に遵守いただく事項および当社と利用者の間の権利義務関係を定めたものです。
These Terms of Use (the "Terms") set forth the matters to be observed by users and the rights and obligations between AMANE LLC (the "Company") and users with respect to the use of AMANE Archives (the "Service"), which the Company provides at https://ourarchives.amane-project.jp/ (the "Site").

本規約への同意と利用 Agreement to These Terms and Use of the Service

　本サービスの閲覧・検索等の利用に際しては、本規約への同意をお願いします。利用者は、本サービスを利用することにより、本規約に同意したものとみなします。もし、同意いただけない場合は、利用をお控えください。
Users are requested to agree to these Terms when using the Service, including browsing and searching. By using the Service, users shall be deemed to have agreed to these Terms. If you do not agree to these Terms, please refrain from using the Service.
本規約の範囲 Scope of These Terms

　本規約は、本サイトにおいて公開されている全てのデジタルアーカイブおよび画像・メタデータに対して適用されます。
These Terms apply to all digital archives, images, and metadata published on the Site.
将来における本規約の変更 Future Amendments to These Terms

　当社は、本規約の内容を将来変更する可能性があります。変更については、①誤字脱字の修正や文章表現の追加・変更などの表現に関する変更と、②新たな方針の反映や公開条件の変更などの基礎的な変更を含みますが、これらに限りません。当社が本規約を変更する場合には、当該変更内容および変更の効力発生日を、本サイトへの掲示その他当社所定の手段により周知するものとし、利用者は本規約の変更後も本サービスを利用することにより、変更後の本規約に同意したものとみなします。
The Company may amend these Terms in the future. Amendments include, but are not limited to, (1) changes in expression, such as the correction of typographical errors and the addition or modification of wording, and (2) fundamental changes, such as the reflection of new policies or changes to the conditions of publication. When the Company amends these Terms, it shall give notice of the content of the amendment and its effective date by posting on the Site or by other means designated by the Company. By continuing to use the Service after an amendment, users shall be deemed to have agreed to the amended Terms.
本サービスの継続性 Continuity of the Service

　当社は、本サービスに関して、限られたリソースでの中長期的な持続的運用に取り組む観点から、WebサイトおよびIIIF画像公開を含む公開サービスの365日24時間安定提供義務を負いません。システムの保守等の理由により停止する場合には、事前にWebおよびSNSにおいて告知を行うよう努めます。しかしながら、予期せぬシステム障害などの理由により、一時的にサービスが停止することがあります。もし、サービスが停止していることを発見した場合はSNS等でお知らせいただけると幸いです。
With a view to sustaining the operation of the Service over the medium to long term with limited resources, the Company does not assume any obligation to provide its public services, including the website and IIIF image delivery, on a stable basis 24 hours a day, 365 days a year. Where the Service is to be suspended for system maintenance or other reasons, the Company will endeavor to give advance notice on the web and on social media. However, the Service may be temporarily suspended due to unexpected system failures or other reasons. If you notice that the Service is unavailable, we would appreciate it if you could let us know via social media or other means.
資料情報の権利・利用条件 Rights and Conditions of Use of Material Information

　本サイトに掲載している画像・メタデータ等の資料情報の権利および２次利用条件については、当社が別途定める場合を除き、以下の通りです。当社は、これらの情報について何らの保証も行いません。利用者は、ご自身の責任において本サービスをご利用ください。利用者が本規約に違反した場合、当社は本サービスの提供を停止し、本規約を解除することができるものとし、当該違反により当社または第三者に損害が生じた場合、利用者は当該損害を賠償する責任を負います。
Unless otherwise specified by the Company, the rights and conditions for secondary use of the material information published on the Site, such as images and metadata, are as set forth below. The Company makes no warranty of any kind with respect to such information. Users shall use the Service at their own responsibility. If a user violates these Terms, the Company may suspend the provision of the Service and terminate these Terms; and if such violation causes damage to the Company or any third party, the user shall be liable to compensate for such damage.

  ：NO COPYRIGHT – CONTRACTUAL RESTRICTIONS （著作権なし – 契約による制限あり）(Rights Statements)
  制限の内容：２次利用・公開に際しては、資料名または資料IDとAMANE Archivesにおいて公開されている旨の記述を表示すること。（CC-BY 4.0に準じる）
  Restriction: When reusing or publishing such data, users shall indicate the title or ID of the material and a statement that it is published on AMANE Archives (in accordance with CC BY 4.0).
　資料情報に著作権及びその他の権利が存在する場合は、特段の定めがない限り各権利保持者に帰属し、日本国著作権法及び国際条約等により保護されています。その他、デジタルコンテンツの2次利用の基本的な方針については、以下のガイドラインに従います。
Where copyright or other rights subsist in material information, such rights belong to the respective rights holders unless otherwise specified, and are protected under the Copyright Act of Japan, international treaties, and other applicable laws. In addition, the basic policy on the secondary use of digital content follows the guidelines below (in Japanese).

　本サービスにおいて公開されている資料情報・利用条件および公開の可否については、将来の学術研究・調査の進展により変更する可能性があります。それらの情報および条件について変更が生じた場合には、本サイト・SNS等で告知するとともに該当資料情報の利用者に通知します。そのため、資料情報を学術研究および資料活用活動等において利用される場合は、あらかじめAMANE Archives運営コミュニティにお知らせいただくことを推奨します。
The material information and conditions of use published on the Service, as well as whether materials may be published, may change in the future as academic research and investigation progress. If any such information or condition changes, the Company will announce the change on the Site, on social media, and by other means, and will notify users of the relevant material information. Accordingly, when using material information for academic research, activities utilizing the materials, or similar purposes, users are encouraged to inform the AMANE Archives Operating Community in advance.

　本サービスは、当社および学術研究者からなる有志の運営コミュニティにより維持・運営されています。運営コミュニティは、本サービス利用者との積極的な交流を望んでいます。利用者へのお知らせなどについては、本サイトおよびSNSへのハッシュタグ付き投稿（＃AMANEArchives）を介して行います。本規約についてのご質問・ご意見などは、お気軽にお寄せください。
The Service is maintained and operated by a voluntary operating community consisting of the Company and academic researchers. The operating community welcomes active engagement with users of the Service. Announcements to users are made through the Site and through social media posts with the hashtag #AMANEArchives. Please feel free to send us any questions or comments regarding these Terms.
準拠法・裁判管轄 Governing Law and Jurisdiction

　本規約は日本法に準拠し、同法によって解釈されるものとします。本規約に関して紛争が生じた場合、東京地方裁判所を第一審の専属的合意管轄裁判所とします。
These Terms shall be governed by and construed in accordance with the laws of Japan. Any dispute arising in connection with these Terms shall be subject to the exclusive agreed jurisdiction of the Tokyo District Court as the court of first instance.
